These Terms of Service (“Terms”) govern your access to and use of the services provided by Click Intelligence pty Ltd (“we”, “us”, or “our”). By using our website or services, you agree to these Terms.

2. Services
We provide data analytics, business intelligence, machine learning, cloud infrastructure, and related consulting services. The specific scope, deliverables, and fees for each engagement are set out in a separate proposal, statement of work, or subscription agreement.
3. Subscription services
Monthly subscriptions are billed in advance. Subscription fees are non-refundable except where required by law. Subscriptions may be cancelled at any time through the cancellation process described in our Refund & Cancellation Policy. The service remains active until the end of the current billing period.
4. Project-based services
For fixed-scope projects, a deposit of 50% is typically required before work begins, with the balance payable on completion. Payment terms are set out in the project proposal.
5. Intellectual property
Upon full payment, we grant the client a licence to use any custom deliverables created specifically for the client. We retain ownership of pre-existing intellectual property, general methodologies, and reusable tools. Any exceptions are documented in the project agreement.
6. Confidentiality
Both parties agree to keep confidential any non-public information disclosed during the engagement, except where disclosure is required by law or authorised in writing.
7. Limitation of liability
To the extent permitted by law, our total liability for any claim arising from our services is limited to the amount paid by the client for the relevant service in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages.
8. Termination
Either party may terminate a project engagement with written notice. If the client terminates before completion, the client remains liable for fees for work performed and expenses incurred up to the termination date.
9. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be submitted to the exclusive jurisdiction of the courts of Victoria.
10. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of our services after changes constitutes acceptance of the updated Terms.
